Dear Ms. Tsiavos: In your letter dated February 20, 2020, you requested a tariff classification ruling. The submitted sample is a teen size costume identified as Dark Arts Academy Witch, item # CT18116, which consists of a dress and a witch hat. GRI 3(b) is applicable when goods are, prima facie, classifiable under two or more headings, and have been put up in sets for retail sale. GRI 3(b) states that the goods “shall be classified as if they consisted of the material or component which gives them their essential character.” The flimsy dress is made of man-made knit textile fabric and imparts the essential character of the set. The flimsy dress features a single ply collar and cuffs with raw unfinished edges, bottom hem and a large back opening with large loose overlock stitching. The back opening is secured with small hook and loop tabs. You state in your letter that the costume will also be offered in girl’s size as item # CG18116, in women’s size as item #CF18116 and in women’s plus size as item # CW18116. All four costumes are identical except for size. The applicable subheading for the Dark Arts Academy Witch costume, item numbers CG18116, CT18116, CF18116 and CW18116 will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other.” The rate of duty will be Free.
