Hawthorne Avenue, Suite 612 Valley Stream, NY 11580 RE: Country of origin of “Lionol Blue 7266-PS Pigment” from Japan Dear Mr. DeFazio: In your ruling request dated March 25, 2019, on behalf of your client, Toyo Ink America, LLC, you requested a country of origin ruling on “Lionol Blue 7266-PS Pigment.” You describe the product at issue as a pigment used in various industries, such as offset printing, newspaper ink, and other ink products. This product is produced in Japan, incorporating various raw materials from Japan, Pthalocyanine Crude D from Germany, Pthalocyanine Crude E and F from India, and Pthalocyanine Crude C from China. You indicate that the manufacturing process includes the production of four intermediate products, before the final manufacturing of the imported pigment. The following is a summary of the described production process in Japan: Acid slurry treatment Precipitation by dilution Filtration and purification Re-slurry rosin treatment Neutralization Solvent salt milling Chlorosulfonation Dissolution into ice Resin emulsion treatment Drying, mixing, milling, packaging, and inspection In 19 C.F.R. § 134.1(b), “country of origin” is defined as “the country of manufacture, production, or growth of any article of foreign origin entering the United States. Further work or material added to an article in another country must effect a substantial transformation in order to render such other country the ‘country of origin’ within the meaning of this part.” With respect to the “Lionol Blue 7266-PS Pigment,” the production process in Japan using various materials from Japan, Germany, India, and China, results in a new product having a distinctive name, character, or use. Therefore, in our opinion, the country of origin for the subject product is Japan. This merchandise may be subject to the requirements of the Toxic Substances Control Act (TSCA), which are administered by the U.S. Environmental Protection Agency.
