Taylor Northeast Hook Fishing Supply, Inc. 160 Presumpscot St. Portland, ME 04103 RE: The tariff classification of an Automatic Jigging Machine from Sweden Dear Ms. Taylor: In your letter dated September 1, 2016 you requested a tariff classification ruling. The automatic jigging machine, model number BJ5000Ex, is designed for use by commercial fisheries to catch small fish such as mackerel but it can be used for larger species of fish. This machine can only be used for fishing. The electronic jigging machine has six selectable fishing programs and the motor is controlled by the Ex system program. It comes supplied with 40mm U-Bolts and brackets which are attached to either side of the machine. The machine can only be connected to a lead battery. The jigging machine allows the fishermen to target the waters where their catch is located. This reduces the chances of catching any unwanted or endangered species. The fisherman sets the jigging machine to the desired depth and jig length which is the length that you want the machine to haul up before it releases and goes down in order to catch the fish. The applicable subheading for the Jigging Machine will be 8479.89.9499, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Machines and mechanical appliances having individual functions, not specified or included elsewhere in this chapter, parts thereof: Other machines and mechanical appliances: Other: Other: Other”. The rate of duty will be 2.5% ad valorem. Duty rates are provided for your convenience and are subject to change. Your inquiry does not provide enough information for us to give a classification ruling on the accessories used with the jigging machine such as pulleys, poles, outriggers, and mackerel wheels.. Your request for a classification ruling on the accessories should include the following: Explain how and where each accessory item is used. What role does each item play in the operation of the jigging machine? Is each item necessary to operate the jigging machine? What is the material composition of each item? What is the function and purpose of the pulleys? Explain fully. Does the pulley transfer torque? If so, what does it transfer torque to? What mechanism does it receive torque from? Please submit exploded labelled view diagrams and other pictorial representations of the pulleys. Show them as they are incorporated into the machine that they are designed to work with. When this information is available, you may wish to consider resubmission of your request. We are returning any related exhibits.
