Inc. 154 Keystone Drive New Castle, PA 16105 RE: The tariff classification of a glass jar from Italy. Dear Mr. Shumaker: In your letter dated August 3, 2016, you requested a tariff classification ruling. The merchandise under consideration is described as the Fido jar, item number 4949Q466. A sample was submitted with your ruling request and will be returned to you. The Fido Jar is a square jar with rounded corners, tapering upwards to a round threaded neck. It measures approximately 4 inches long by 4 inches wide by 3.625 inches high. From the information you provided, this jar has a capacity of 19 ounces and is made of clear soda-lime glass which is not pressed or toughened (specially tempered), and has a linear coefficient of expansion which exceeds 5 x 10-6 per Kelvin within a temperature range of 0°C to 300°C. It is imported and sold without a lid, and you do not sell lids separately. You state that the jar will be used for food consumption and the unit value is not over three dollars. The applicable subheading for the Fido jar, item number 4949Q466, will be 7013.49.2000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Glassware of a kind used for table, kitchen, toilet, office, indoor decoration or similar purposes…: Glassware of a kind used for table (other than drinking glasses) or kitchen purposes, other than of glass-ceramics: Other: Other: Valued not over $3 each.” The general rate of duty will be 22.5 percent ad valorem.
