Von Rentzell President BluTec Systems, LLC 2665 Longacres Dr. Chanhassen, MN 55317 RE: The tariff classification of a wireless optical communication system from Russia or Hungary Dear Mr. Von Rentzell: In your letter dated June 20, 2016, you requested a tariff classification ruling. The merchandise concerned is referred to as the Trimble FSO (free space optics) Gigabit Series, Optical Communication System. This system consists of two infrared (IR) transceivers along with electronic communication equipment that allows its incorporation into an existing network. This system is used to wirelessly transmit voice, images and data between two points. The pair of wireless optical IR transceivers are used in place of a wired connection. It’s an alternative to running fiber optic cable underground. The installation of a fiber optic cable may be difficult in certain instances (under a river or lake, across a freeway or airport, etc.), so the wireless system allows the signal to be beamed across the inaccessible space. The system can only communicate up to a maximum of approximately 2.5 miles. The applicable subheading for the Trimble FSO (free space optics) Gigabit Series, Optical Communication System will be 8517.62.0050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “…: Machines for the reception, conversion and transmission or regeneration of voice, images or other data, including switching and routing apparatus: Other.” The general rate of duty will be Free.
