Higgins Rd., Suite 103 Elk Grove Village, IL 60007 RE: The tariff classification of a steel threaded fastener from China Dear Ms. Benkler: In your letter dated May 11, 2016, you requested a tariff classification ruling on behalf of Wurth Service Supply, Inc. The submitted sample will be retained by this office. The product under consideration, part number S-10260, is described in your letter as a “Hex Flange Bolt.” It is made of zinc-plated carbon steel, measures 5/16 - 18 x 1, and features a fully threaded shank, hexagonal flange head, chamfered point, and a captive polyethylene washer underneath the head. Consideration was given to classifying part number S-10260 as a bolt in subheading 7318.15.2065, Harmonized Tariff Schedule of the United States (HTSUS), as you proposed. However, after consulting ANSI/ASME Standard B18.2.1 and reviewing the features of this fastener in relation to the criteria, part number S-10260 is determined to be a cap screw, greater than 6 mm in diameter. The applicable subheading for part number S-10260 will be 7318.15.8066, HTSUS, which provides for screws, bolts, nuts, coach screws, screw hooks, rivets, cotters, cotter pins, washers (including spring washers) and similar articles, of iron or steel: threaded articles: other screws and bolts, whether or not with their nuts or washers: other: having shanks or threads with a diameter of 6 mm or more: other: other: with hexagonal heads: other: cap screws. The duty rate will be 8.5% ad valorem. Duty rates are provided for your convenience and are subject to change.
