The tariff classification of four coated roller shade fabrics from Germany
N273680 April 6, 2016 CLA-2-59:OT:RR:NC:N3:350 CATEGORY: Classification TARIFF NO.: 5903.90.2500 Ms. Jennifer Sharkey Springs Window Fashions, LLC 7549 Graber Road Middleton, WI 53562-1096 RE: The tariff classification of four coated roller shade fabrics from Germany Dear Ms. Sharkey: In your letter dated February 22, 2016, you requested a tariff classification ruling. Samples were provided. The woven fabrics are identified with the following Pattern Names and Numbers: Lima 40824, Lima Effect Print 420570, Carina 40570 and Carina Print 40015. According to the information provided, these fabrics are of plain weave construction, are composed of 100% polyester staple yarns, and weigh from 175 to 200 g/m2. You indicate that the fabric has been coated with a polyacrylate plastic, with a coating weight of 34.2 to 48%, using a coating method described as “knife paste application, heat cured, both sides.” Although the yarns retain their fibrous nature, this coating is visible to the naked eye, especially in the interstices of the weave and open areas of the fabric. You state that this fabric will be imported in widths of 200-240 centimeters and will be used for the manufacture of roller shades for windows. The applicable subheading Patterns Lima 40824, Lima Effect Print 420570, Carina 40570 and Carina Print 40015 will be 5903.90.2500 Harmonized Tariff Schedule of the United States (HTSUS), which provides for textile fabrics impregnated, coated, covered or laminated with plastics, other than those of heading 5902: other: of man-made fibers: other. The rate of duty will be 7.5 percent ad valorem. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the assumption that the subject goods, in their condition as imported into the United States, conform to the facts and the description as set forth both in the ruling request and in this ruling. In the event that the facts or merchandise are modified in any way, you should bring this to the attention of Customs and you should resubmit for a new ruling in accordance with 19 CFR 177.2. You should also be aware that the material facts described in the foregoing ruling may be subject to periodic verification by Customs. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
