N272202 January 27, 2016 CLA-2-95:OT:RR:NC:N4:425 CATEGORY: Classification TARIFF NO.: 9505.90.6000 Mr. Joseph Stinson Omni Global Sourcing Solutions, Inc. 4050 S. 26th Street, #200 Philadelphia, PA 19112 RE: The tariff classification of costumes from China. Dear Mr. Stinson: In your letter dated December 30, 2015, you requested a tariff classification ruling. The submitted sample identified as Rite Aid item number 9038869, is an assortment of two adult size costumes, the Gothic Devil/Witch Assortment, which each consist of a long sleeve dress and headpiece. GRI 3(b) is applicable when goods are, prima facie, classifiable under two or more headings, and have been put up in sets for retail sale. GRI 3(b) states that the goods “shall be classified as if they consisted of the material or component which gives them their essential character.” The flimsy pullover dress imparts the essential character of the set. Both dresses have exactly the same construction, with both featuring raw, jagged cut sleeves and hem and large side slit with hanging threads. The applicable subheading for Rite Aid Item Number 9038869 will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other.” The rate of duty will be Free.
