Dear Ms. Cao: In your letter received April 14, 2015, you requested a tariff classification ruling. The merchandise under consideration is referred to as “9in Glass Cone Bottle,” item number C16568. Samples of the item were submitted with your ruling request and were retained by this office. The 9in Glass Cone Bottle is similar to an Erlenmeyer flask in shape. It measures approximately 9.375 inches high, with a base measuring approximately 5 inches in diameter tapering to a neck opening measuring approximately 1.75 inches in diameter. The bottle is closed by means of a cork stopper. Around the neck of the bottle is a black lace-like open work knit ribbon, tied in a bow. One sample of the bottle features a black label printed with the words “Premade Vampire Blood Drink At Your Own Risk;” the other sample features an orange label printed with the words “100% Supernatural Bat Droppings Fingertips Partially Decomposed Lightly Salted.” In an email to this office you indicated that the glass is pressed but not toughened, and that the unit value is over thirty cents but not over three dollars. You also stated that the bottles are designed to be placed on display with nothing inside, and are not safe for food use. The applicable subheading for the 9in Glass Cone Bottle, item number C16568, will be 7013.99.5000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Glassware of a kind used for table, kitchen, toilet, office, indoor decoration or similar purposes…: Other glassware: Other: Other: Other: Valued over $0.30 but not over $3 each.” The general rate of duty will be 30 percent ad valorem.
