Calloway Herbalife International of America, Inc. 950 W. 190th Street Torrance, CA 90502 RE: The tariff classification of protein drink mix Dear Ms. Calloway: In your letter dated February 27, 2015 you requested a tariff classification ruling. Ingredients breakdown and sample accompanied your letter. Samples were reviewed and disposed of. The subject merchandise is described as a nutritional drink mix, Formula 1 Chocolate Powdered Shake Preparation Sku# 4003MX which is based on Herbalife Master Formula F2141. The product is said to contain: soy protein isolate, fructose powder, low-fat cocoa powder, cellulose powder, corn bran, mineral premix, guar gum powder and less than one percent of other ingredients. The drink mix is in powder form and put up for retail sale in 572 gram plastic jars. When mixed with skim or soy milk it makes a meal replacement drink. The applicable subheading for the Formula 1 Chocolate Powdered Shake Preparation Sku# 4003MX will be 1806.90.9090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for chocolate and other food preparations containing cocoa…other … other…other. The rate of duty will be 6 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
