Kopecky The Happy Dolphin 7040 Hawaii Kai Drive, Suite 26233 Honolulu, HI 96825 RE: The tariff classification of a glass souvenir decoration from China. Dear Mr. Kopecky: In your letter dated February 2, 2015, you requested a tariff classification ruling. The merchandise under consideration is referred to as “Hawaii in a Bottle.” From the information and photographs you provided, this is a tourist souvenir item designed for display on a shelf as a decoration. Hawaii in a Bottle is comprised of a corked, clear glass bottle shaped to resemble a stylized hibiscus flower which measures approximately 3.54 inches wide, 4.72 inches high and 1.38 inches deep at its widest points. You state that the glass is not tempered. A silk flower lei is wrapped around the neck of the bottle. On the front of the bottle is a cut-out label which reads “Hawaii in a Bottle.” Affixed to the inside back of the bottle is a paper label which is printed on both sides with a cartoon-style, stylized Hawaiian-themed scene. Within the bottle are grains of plastic meant to simulate sand as well as two plastic figurines which you state measure between approximately .79 and 1.18 inches high. The printed label, plastic sand and plastic figurines create a three-dimensional scene within the glass bottle. You state that the unit value is over thirty cents but not over three dollars. Hawaii in a Bottle is a composite good comprised of different materials that are classifiable in different headings. Classification of merchandise under the Harmonized Tariff Schedule of the United States (HTSUS) is in accordance with the General Rules of Interpretation (GRIs) taken in order. General Rule of Interpretation (GRI) 3(b) of the Harmonized Tariff Schedule of the United States (HTSUS) provides, in relevant part, that composite goods which cannot be classified by reference to GRI 3(a) shall be classified as if they consisted of the material or component which gives them their essential character. The glass component provides the essential character of this item. The applicable subheading for the Hawaii in a Bottle will be 7013.99.5000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Glassware of a kind used for table, kitchen, toilet, office, indoor decoration or similar purposes…: Other glassware: Other: Other: Other: Valued over $0.30 but not over $3 each.” The general rate of duty will be 30 percent ad valorem.
