N260695 February 2, 2015 CLA-2-95:OT:RR:NC:N4:424 CATEGORY: Classification TARIFF NO.: 9503.00.0073 Mr. Ken Ayoub Sugar Lulu LLC PO Box 1313 50 Washington Street, Suite 201 Norwalk, CT 06854 RE: The tariff classification of “Message in a Bottle” craft kit from China Dear Mr. Ayoub: In your letter dated January 5, 2015, you requested a tariff classification ruling. A sample of the “Message in a Bottle” necklace craft kit was submitted with your request. The “Message in a Bottle” kit comes in 8 different varieties of messages which include: “Living the Dream,” “Always In My Heart,” “Normal is Boring,” “Love Thy Selfie,” “Not a Morning Person,” “Nothing to Wear,” “Believe In Yourself,” and “Keep Calm Stand Out.” A ninth variety is called “the special Camp edition” which includes letter beads that spell out “GO” plus a favorite team’s color. Available team colors are: blue, green, white, red, gold, pink, purple, orange, and black. The item is packaged in a plastic bottle, approximately 4” in height, which is opened by twisting off the bottom. The bottle contains a number of small lettered beads and spacers that can be strung together to create the appropriate saying. The kit also contains a clasp closure and string which is adjustable to any desired length. As assembled, the completed items will be flimsily constructed and, in all likelihood, will not be used over a long period of time. The kit’s amusement value is greater than the utilitarian value of the finished article and will be classified as an educational toy. The “Message in a Bottle” is principally designed for the amusement of children 8 years of age and older. The applicable subheading for the “Message in a Bottle” craft kit will be 9503.00.0073, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Tricycles, scooters, pedal cars and similar wheeled toys…dolls, other toys…puzzles of all kinds; parts and accessories thereof… ‘Children’s products’ as defined in 15 U.S.C. § 2052: Other: Labeled or determined by importer as intended for use by persons: 3 to 12 years of age.” The rate of duty will be Free.
