Rasco Metro Customs Brokers 1 Lincoln Boulevard Suite #202 Rouses Point, New York 12979 RE: The tariff classification of three woven fabrics laminated to a polyurethane backing, from China Dear Ms. Rasco: In your letter dated October 3, 2014, on behalf of your client, 172661 Canada Inc. DBA Aquila Textiles, you requested a tariff classification ruling. Three fabric samples were submitted with your ruling. Styles Luna, Rondelle and Granby are woven fabrics in assorted colors. All three styles are visibly coated on one side of the fabric. According to your letter, subsequent contact and the specification sheet provided, the face fabric on all three styles is composed of 50% textured filament polyester and 50% polypropylene filament yarns, with a polyurethane backing. Your correspondence indicates that these fabrics weigh 155 grams per square meter, will be imported in 90-inch widths, and will be used as an interior fire barrier in the manufacture of quilted foam mattresses. The applicable subheading for Styles Luna, Rondelle and Granby will be 5903.20.2500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Textile fabrics impregnated, coated, covered or laminated with plastics, other than those of heading 5902: With polyurethane: Of man-made fibers: Other: Other (not over 70 percent by weight of rubber or plastics). The rate of duty will be 7.5 percent ad valorem. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). This ruling is being issued under the assumption that the subject goods, in their condition as imported into the United States, conform to the facts and the description as set forth both in the ruling request and in this ruling. In the event that the facts or merchandise are modified in any way, you should bring this to the attention of Customs and you should resubmit for a new ruling in accordance with 19 CFR 177.2. You should also be aware that the material facts described in the foregoing ruling may be subject to periodic Customs laboratory analysis at the time of importation and to verification by Customs, and the fabric may be reclassified at that time. A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
