Virginia Street – Suite 300 Milwaukee, WI 53204 RE: The tariff classification of SternCream from Sri Lanka Dear Ms. Siegel: In your letters dated April 19, July 3 and August 19, 2014, you requested a tariff classification ruling on behalf of Berg & Schmidt America, LLC. An ingredients breakdown and production flow chart accompanied your August letter. The sample received with your July letter was examined and disposed of. The product SternCream is a white powder said to contain 78-90 percent coconut milk solids, 8-13 percent maltodextrin, 4-5.5 percent sodium caseinate and 1.5 percent water. The production flow chart indicates that maltodextrin and sodium caseinate are added into the coconut milk then pasteurized, homogenized and sprayed dried into coconut milk powder. The product is then packaged, imported and sold in 15kg cardboxes, net weight. SternCream will be used in many food applications, such as, beverages, sauces, dressings, and ice cream. The applicable subheading for the product will be 2106.90.9998, Harmonized Tariff Schedule of the United States, HTSUS, which food preparations not elsewhere specified or included . . . other . . . other . . . other. The rate of duty will be 6.4 percent, ad valorem.Duty rates are provided for your convenience and are subject to change. The GSP is subject to modification and periodic suspension, which may affect the status of your transaction at the time of entry for consumption or withdrawal from warehouse.
