Centennial Avenue Aiken, SC 29803 RE: The tariff classification of decorative glass articles from China Dear Ms. Glover: In your letter dated July 2, 2014 you requested a tariff classification ruling on behalf of your client, Epic Products, Inc. The subject merchandise consists of three Wine Glass Ornaments and one Martini Glass Ornament. The items are identified as styles: 02-152, “Sit Stay Drink” (Wine Glass Ornament); 02-153, “Taste of Purrfection” (Wine Glass Ornament); 02-166, “What’s Shakin’?” (Martini Glass Ornament); 02-167, “Party Girl!” (Wine Glass Ornament). Representative samples were submitted to our office for examination. The samples will be returned to you as requested. The items are decorative glass articles designed to look like miniature wine glass hanging ornaments. The items are hand painted with patterns which feature a dog, cat, olives; or a phrase, such as “Party Girl!” depicting a theme for each style. The three wine glass products measure approximately four inches high with a diameter of one and one quarter inches wide. The remaining martini glass article measures approximately three and one half inches high with a diameter of two and one quarter inches wide. Each miniature wine glass ornament has a coordinating colored ribbon looped through a hole to facilitate hanging. The items are decorative glass articles designed to be hung or placed on a flat surface for display. Your letter indicates that the unit value of the article is over thirty cents but not over three dollars. The applicable subheading for the Wine Glass Ornaments and the Martini Glass Ornament will be 7013.99.5000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for glassware of a kind used for table, kitchen, toilet, office, indoor decoration or similar purposes…other glassware: other: other: other: valued over thirty cents but not over three dollars each. The rate of duty will be 30 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
