Victoria Street, Suite # 220 Long Beach, CA 90805 RE: The tariff classification of a bracelet from China. Dear Ms. Illes: In your letter dated May, 23, 2014, on behalf of Los Angeles Gem & Jewelry Design, you requested a tariff classification ruling. As requested, the sample submitted will be returned to you. No bill of materials was provided and only a partial material breakdown was furnished. Item # 538543 is identified on the specification sheet, under sub-item, as the “Love This Life” bracelet. The wire bangle bracelet is composed of stainless steel. Attached to the wire bangle bracelet is: one dangling large charm made of silver-plated brass with a flash of palladium under plate, having an anchor cross emblem and two hearts (one heart on each side of the cross), along with the inscription you and me and three heart symbols (two hearts on each side of the word “you” and one heart following the word “me”); one dangling small charm made of stainless steel with the inscription love this life; and one dangling large, faceted crystal bead. On the opposite (reverse) side of the cross emblem with inscription and hearts there is 1mm of faceted crystals with white clay. Although not identified, for purposes of this ruling, the crystals will be considered to be of glass. Legal Note 11 to Chapter 71 of the Harmonized Tariff Schedule of the United States (HTSUS) provides that for the purposes of heading 7117, the expression “imitation jewelry” means articles of jewelry within the meaning of paragraph (a) of note 9 above (but not including buttons or other articles of heading 9606, or dress combs, hair slides or the like, or hairpins, of heading 9615), not incorporating natural or cultured pearls, precious or semiprecious stones (natural, synthetic or reconstructed) nor (except as plating or as minor constituents) precious metal or metal clad with precious metal. See Legal Note 9 (a), HTSUS, for exemplars of articles of jewelry. In respect to the Love This Life charm bangle bracelet, the merchandise concerned is to be classified as imitation jewelry in heading 7117, HTSUS, as it does not contain any precious or semiprecious gemstones. Accordingly, this item is classified as imitation jewelry in subheading 7117.19, HTSUS. The applicable subheading for item number 538543, Love This Life charm bangle bracelet, will be 7117.19.9000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Imitation Jewelry: Of base metal, whether or not plated with precious metal: Other: Other: Other.” The rate of duty will be 11% ad valorem.
