N253838 June 6, 2014 CLA-2-94:OT:RR:NC:N4:110 CATEGORY: Classification TARIFF NO.: 9405.50.4000 Mr. Joseph Stinson OMNI Global Sourcing Solutions, Inc. 7746 Dungan Road Philadelphia, PA 19111 RE: The tariff classification of a metal candle holder from China Dear Mr. Stinson: In your letter dated May 22, 2014, you requested a tariff classification ruling. The item under consideration is the Harvest Candleholder Centerpiece, Item Number 9025120. A sample was submitted with your letter and will be returned to you. Item Number 9025120 is a metal (non-brass) candle lamp measuring approximately 8 inches tall. The item consists of a circular base made of metal wire decorated with artificial foliage such as flowers, leaves and berries. A metal circular candle holder designed to contain a standard pillar candle (not included) is extended above from the base/foliage by a swirled metal wire. The candle lamp is designed to be placed onto virtually any flat surface and to provide unobstructed light. The applicable subheading for the Harvest Candleholder Centerpiece, Item Number 9025120 will be 9405.50.4000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Lamps and lighting fittings…Non-electrical lamps and lighting fittings: Other: Other.” The rate of duty will be 6 percent. Duty rates are provided for your convenience and are subject to change.
