Robinson International, Inc. 1501 N Mittel Blvd. Suite A Wood Dale, IL 60191 RE: The tariff classification of a Spy Gear Tactical Vest™ from China. Dear Ms. Lynch: In your letter dated May 5, 2014, on behalf of Spin Master, Inc., you requested a tariff classification ruling. The submitted sample, a Spy Gear Tactical Vest™, identified as product number 6022383, is constructed of 80% poly oxford fabric, 10% nylon webbing, 5% plastic, and 5% elastic. The single-layer seamless article has non-adjustable shoulder straps with hook and loop tab closures, a full-front opening with raw edges, a clear plastic left breast pocket with a hook and loop tab closure intended to hold the Spy Gear Under Cover Spy Cam™ (not included), elastic gear loops, and a built-in light beacon permanently attached to the top right side that is used to signal the child’s friends. The article also has visible loose overlock stitching at the armholes and the bottom hem, and has the Spy Gear initials “SG” screen-printed on the lower right front of the article. You state that the article is “not intended to be washed” and is marketed for children play-acting as a spy. Your sample is being returned as requested. The applicable subheading for product number 6022383 will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other.” The rate of duty will be Free.
