Highland Ave NE Atlanta GA, 30307 RE: The tariff classification of Parts used in the 3/2 Solenoid Valve NV116 from Germany. Dear Mr. Eich: In your letter dated April 03, 2014 you requested a tariff classification. The merchandise under consideration is described as parts of the 3/2 Solenoid Valve NV116: “Ball” Part Number 12303 020, “Sealing Seat” Part Number 16408 001, “Pole Part” Part Number 16413 002, and “Armature” Part Number 16407 002, and “Disk” Part Number 16417 001. The Sealing Seat, Part Number 16408 001is constructed of Steel and is manufactured though a turning process. The item measures approximately 5.95 mm x 1.8 mm and weighs 0.2 grams. It has been stated; the Sealing Seat with the Actuator Pin is part of the mechanism that opens and closes electrical connections. The Pole Part, Part Number 16413 002 is constructed of Steel and is manufactured though a cold extrusion process. The item measures approximately 23 mm x 10.6 mm and weighs 9.9 grams. It is said; the Pole Part is a part of the magnetic circuit and conducts the magnetic flux. The Armature, Part Number 16407 002 is constructed of Steel and is manufactured though a cold extrusion process. The item measures approximately 8.7 mm x 15.1 mm and weighs 6.8 grams. The Armature is designed to move up and down by applying current to the coil which in turn moves the Actuator Pin. You have suggested classifying part numbers 16408 001, 16413 002 and 16407 002 within heading 7318, HTSUS.  This heading provides for screws, bolts, nuts, coach screws, screw hooks, rivets, cotters, cotter pins, washers (including spring washers) and similar articles, of iron or steel.  Classification of merchandise under the Harmonized Tariff Schedule of the United States is governed by the General Rules of Interpretation (GRIs) taken in order.  GRI 1 provides that classification is determined first in accordance with the terms of the headings and any relative section and chapter notes.  Part number 16408 001 (described as a sealing seat), part number 16413 002 (described as a pole part) and part number16407 002 (described as an armature) are not ejusdem generis to the exemplars of heading 7318.   Therefore, your suggested classification would be incorrect.  The Disk, Part Number 16417 001 is constructed of Steel and is manufactured though a stamping process. The item measures approximately 23 mm x 4 mm and weighs 7.5 grams. It is said; the Disk is also a part of the magnetic circuit and conducts the magnetic flux. Based on our review of the information available to our office, the subject steel discs are not classifiable under heading 7326, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other articles of iron or steel.  Heading 7326 covers a wide range of iron or steel articles that are not more specifically provided for elsewhere in the HTSUS.  The steel discs under consideration are not classifiable under heading 7326 (and therefore subheading 7326.90.8588), HTSUS, because the merchandise in question is provided for more specifically in another heading of the HTSUS. Therefore, your suggested classifications would be incorrect.  The Sealing Seat Part Number, 16408 001, the Pole Part, Part Number 16413 002, the Armature, Part Number 16407 002, and the Disk, Part Number 16417 001 are all parts of a valve assembly that controls the flow of fluid within a fluid power transmission system. Valves for hydraulic power transmission systems are specifically provided for in subheading 8481.20 of the Harmonized Tariff Schedule of the United States (HTSUS). The applicable subheading for the Sealing Seat Part Number, 16408 001, the Pole Part, Part Number 16413 002, the Armature, Part Number 16407 002, and the Disk, Part Number 16417 001 will be 8481.90.9040, HTSUS, which provides for other parts of the valves of subheading 8481.20. The rate of duty is free. Your inquiry does not provide enough information for us to give a classification ruling on the Ball, Part Number 12303 020. Your request for a classification ruling should include the answers to the following questions: Provide a sample, and detailed literature explaining how the item functions.   What is the Ball made out of, e.g. Alloy Steel?  What are the exact dimensions of the ball? Specifically, does the nominal diameter of the Ball differ by more than one percent or by more than .05 mm? When this information is available, you may wish to consider resubmission of your request.
