Box 3165 Harrisburg, PA 17105 RE: The tariff classification of an inflatable yard decoration from China. Dear Ms. Aldinger: In your letter dated February 21, 2014, you requested a tariff classification ruling. You submitted a sample identified as item number 9024258, Lighted Inflatable Turkey, which depicts a turkey wearing a pilgrim hat and a vest with a pilgrim-style collar. The article appears to be made of textile fabric and plastic and features a built-in fan to inflate the decoration, three internal LED lights for night display, and plastic yard stakes to tether the item to the ground. The LED lights serve only to illuminate the article and do not provide light to the surrounding area. The article serves no utilitarian purpose and will be used purely as an outdoor decoration for Thanksgiving. The applicable subheading for item number 9024258 will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other.” The rate of duty will be Free.
