The tariff classification of a pet toy from China. Correction to Ruling Number N245577
N246612 September 26, 2013 CLA-2-63:OT:RR:NC:N3:351 CATEGORY: Classification TARIFF NO.: 6307.90.7500 Ms. Maureen D. Hannah Atlantic Customs Brokers, Inc. 2016 Linden Boulevard Elmont, NY 11003 RE: The tariff classification of a pet toy from China. Correction to Ruling Number N245577 Dear Ms. Hannah: This replaces Ruling Number N245577, dated Sept. 20, 2013, which contained a clerical error. We classified the pet toy in the wrong subheading within heading 6307, Harmonized Tariff Schedule of the United States, (HTSUS). A complete corrected ruling follows. In your letter dated August 22, 2013, you requested a tariff classification ruling on behalf of your client, About Pets LLC, located in Weston, Connecticut. You submitted a sample of a pet toy for dogs. The pet toy is made up with woven textile fabric, rope and a round rubber squeaker ball. At the top of the pet toy, the woven textile fabric caps over the 2-1/2” rubber squeaker ball. The rope is twisted over and around the neck of the toy creating a 4” knot directly under the squeaker ball. Four 8” long strips of sewn-down fabric hang from the base of the wrapped rope. Overall the item measures 14” long. This pet toy is not a chew toy to develop a pet’s teeth. To use, the pet owner will either toss the toy to the dog for exercise or allow the pet to tug the toy and enjoy the squeaking noise. The applicable subheading for the pet toy will be 6307.90.7500, HTSUS, which provides for other made up textile articles, other: Toys for pets, of textile materials. The rate of duty will be 4.3% ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. The sample was previously returned. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Mitchel Bayer at (646) 733-3102. Sincerely, Myles B. Harmon Acting Director National Commodity Specialist Division
