N245709 September 23, 2013 CLA-2-42:OT:RR:NC:N4:441 CATEGORY: Classification TARIFF NO.: 4202.92.4500 Gary Chasser Morgan Home Fashions 75 Lower Main Street Aberdeen, NJ 07747 RE: The tariff classification of a beach caddy from China Dear Mr. Chasser: In your letter dated August 27, 2013, you requested a tariff classification ruling. You have submitted a sample, which is being returned to you. You have referred to the submitted sample as a beach caddy. It is constructed with an outer surface of plastic sheeting. It provides storage, protection, portability, and organization to sunscreen, a phone, a hair brush, a wallet, or other personal effects. It is tri-fold in design and has a tie closure, one handle, two large zippered interior pockets, and two small zippered interior pockets. In its folded, empty, and closed condition, it measures approximately 10.25” (W) x 9” (H) x 2” (D). When opened, it extends to approximately 26” (H). The applicable subheading for the beach caddy will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for travel, sports, and similar bags, with outer surface of sheeting of plastic, other. The rate of duty will be 20 percent ad valorem. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
