N241628 May 22, 2013 CLA-2-63:OT:RR:NC:N3:351 CATEGORY: Classification TARIFF NO.: 6307.90.9889 Ms. Jeanette Arciero Barthco International, Division of OHL One CVS Drive Woonsocket, RI 02895 RE: The tariff classification of a scouring sponges from China Dear Ms. Arciero: In your letter dated May 3, 2013, you requested a tariff classification ruling on behalf of your client, CVS/Pharmacy. You submitted three packages of scouring sponges, items 925682, 925686, and 925683. The packaged sponges are used in the home for cleaning and scouring surfaces. The rectangular scouring sponges are made up of knit pile textile fabric covering a cellular plastic foam pad. Styles 925682 and 925686 contain two sponges per package that measure 5-1/4” x 3-1/2”. Style 925683 contains four sponges that measure 3-1/4 x 4-3/4”. The essential character of these composite goods (textile and plastic) is imparted by the textile fabrics that actually do the scrubbing and scouring. General Rule of Interpretation (GRI) 3(b), Harmonized Tariff Schedule of the United States (HTSUS), noted. The applicable subheading for the scouring sponges, item numbers 925682, 925683 and 925686, will be 6307.90.9889, HTSUS, which provides for other made up textile articles, other. The rate of duty will be 7% ad valorem. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
