Dear Ms. Kessens: In your letter dated March 4, 2013, you requested a tariff classification ruling. The sample will be retained for our files. The submitted sample, identified as a Stocking Wave Cap, SKU number 02383209, is constructed of 100% nylon fabric. Although you state that the item is woven, upon examination it was determined that the fabric is actually of knit construction. The item is a sheer, tightly fitting hairnet with a reinforced band around the edge to facilitate holding to the head. The applicable subheading for SKU number 02383209 will be 6505.00.0100, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Hats and other headgear, knitted or crocheted or made up from lace, felt or other textile fabric, in the piece (but not in strips), whether or not lined or trimmed; hair-nets of any material, whether or not lined or trimmed: Hair-nets." The rate of duty will be 9.4 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
