Arango, Incorporated 1516 East 8th Avenue Tampa, FL 33605 RE: The tariff classification of a drawstring gift bag China Dear Ms. Knipper: In your letter dated February 27, 2013, you requested a tariff classification ruling on behalf of your client, Cousin Corporation of America. You submitted two samples of gift bags; both are made up from woven nylon fabric. The gift bags measure approximately 2-3/4" x 4". Style AJM66012006 is cream-colored while style AJM66012010 is silver with metallic hearts. You say in your letter that these bags will be marketed to jewelry stores. Due to the nature of the fabric and the construction, the bags can easily be torn when pulled. These gift bags are not considered durable for the purposes of storage or repetitive use. The applicable subheading for gift bags, styles AJM66012006 and AJM66012010, will be 6307.90.9889, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for other made up textile articles, other. The rate of duty will be 7% ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. The samples will be returned. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
