N237904 February 25, 2013 CLA-2-70:OT:RR:NC:2:226 CATEGORY: Classification TARIFF NO.: 7013.99.9000 Ms. Maya Kessler Costco Wholesale Corporation 999 Lake Drive Issaquah, WA 98027 RE: The tariff classification of a decorative glass article from China Dear Ms. Kessler: In your letter which was received in this office on January 30, 2013, you requested a tariff classification ruling. A photograph of the article was submitted with your ruling request. The product under consideration, designated as Costco Item #678181, is a decorative glass article in the form of a sun or starburst. The overall dimensions of the article are 45 inches by 45 inches. It includes a glass mirror with a metal frame (approximately 10 inches in diameter) which appears as the central orb of the decorative design plus varying lengths of metal spokes or rods which appear as the rays of the decorative design. These spokes are accented with several small circular glass mirrors. The small glass mirrors, in two different sizes, are alternately spaced on each rod. The ornamental article will be packaged in a retail cardboard box and is designed to be hung on a wall. You advised our office that the value of Costco Item #678181 is over three dollars. The applicable subheading for the decorative glass article, Costco Item #678181 , will be 7013.99.9000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for glassware of a kind used for table, kitchen, toilet, office, indoor decoration or similar purposes… other glassware: other: other: other: valued over three dollars each: other: valued over five dollars each. The rate of duty will be 7.2 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
