Dear Mr. Sarmiento: In your letter dated January 24, 2013, you requested a tariff classification ruling on behalf of Barrow Industries, Inc. A sample of the bonded fabric was provided with the request letter. Additional samples of the face and backing fabrics prior to the brushing and finishing operations were also provided. Your sample is being returned at your request, less those portions destroyed in testing or retained for file purposes. The submitted sample, identified as Item M9476, is a bonded fabric consisting of a woven face fabric laminated to a knit backing fabric. The adhesive that bonds these fabrics together is not visible in the cross section. The face fabric is characterized by a soft brushed surface arranged in a herringbone pattern. Customs and Border Protection (CBP) laboratory analysis indicates that the face fabric is composed wholly of polyester, weighs 364.2 g/m2, and is of a woven weft pile construction. The backing fabric is composed wholly of polyester, weighs 129.3 g/m2, and is of weft knit extended sinker loop brushed pile construction, containing 6.5 stitches per centimeter in the vertical direction. The bonded fabric weighs 493.5 g/m2. According to your submission and subsequent telephone and email correspondence, this fabric will be imported in rolls measuring 59 inches (150 centimeters) in width, and will be used for upholstery. Note 1 to Chapter 60 states in part that this chapter does not cover: (c) Knitted or crocheted fabrics, impregnated, coated, covered or laminated, of Chapter 59. However, knitted or crocheted pile fabrics, impregnated, coated, covered or laminated, remain classified in heading 6001. Since the laminated fabric before us for consideration incorporates a knit pile fabric, note 1(c) to Chapter 60 specifically includes it within the scope of heading 6001, HTS. The applicable subheading for the Item M9476 will be 6001.22.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for pile fabrics, including “long pile” fabrics and terry fabrics, knitted or crocheted: looped pile fabrics: of man-made fibers. The rate of duty will be 17.2% ad valorem. Duty rates are provided for your convenience and are subject to change.
