The submitted sample, Style EZ049 Flowy Tank Top, is a woman’s tank top constructed of 65 percent polyester and 35 percent cotton knit fabric. The sleeveless garment features a U-shaped front neckline; a racer style back neckline; 1 inch wide shoulder straps; and a hemmed bottom. The garment will be imported in sizes XS-4XL. The same style with a different fiber content was the subject of binding ruling number N237250. We are returning your sample. The applicable subheading will be 6109.90.1065, Harmonized Tariff Schedule of the United States (HTSUS), which provides for tank tops…knitted or crocheted: Of man-made fibers: Women’s. The duty rate will be 32% ad valorem. Duty rates are provided for your convenience and are subject to change.
