Lincoln Ave., Suite 300 Valley Stream, NY 11580 RE: The tariff classification of Amande Chocolat “White” from Japan Dear Ms. Miniaci: In your letter dated August 27, 2012 you requested a tariff classification ruling. You submitted product samples and descriptive literature with your request. Samples were reviewed and disposed of. The subject merchandise is Amande Chocolat “White” (item # 2002) and is described as almonds that are coated in white chocolate. It is said to contain 28.4 percent cocoa butter, 28.3 percent almonds, 22.5 percent whole milk powder, 20.5 percent sugar, 0.26 percent emulsifier, and 0.04 percent flavor. Amande Chocolat “White” is packed in a clear plastic pouch (net weight of 7.1 ounces). It is a product of Japan and packaged for retail sale. The applicable subheading for the Amande Chocolat “White” (item # 2002) will be 1704.90.3550, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sugar confectionery (including white chocolate), not containing cocoa: other: confections or sweetmeats ready for consumption: other: other: put up for retail sale: other. The rate of duty will be 5.6 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
