Shira Sharretts, Paley, Carter & Blauvelt, P.C. 75 Broad Street New York, NY 10004 RE: The tariff classification of a toiletry bag from Italy Dear Ms. Shira: In your letter dated June 19, 2012, you requested a tariff classification ruling, on behalf of your client, Michael Kors. Your sample will be returned to you. You have submitted a sample of toiletry bag without a style number. You state in your letter that the article is constructed of reinforced plastics. The outer surface constituent material is the layer of plastic sheeting. The bag is designed and sized to provide storage, protection, portability, and organization to cosmetics, toiletries and similar personal effects during travel. It has a textile-lined storage compartment with open pockets along the width of both interior sidewalls. The bag secures with a metal zipper closure at the top and has an open pocket on the front exterior. It measures approximately 8” (W) x 4.25” (H) x 2.5” (D). The applicable subheading for the toiletry bag will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for travel, sports and similar bags, with outer surface of plastic sheeting or of textile materials, other. The rate of duty will be 20% ad valorem. Duty rates are provided for your convenience and are subject to change.
