N221792 June 29, 2012 CLA-2-63:OT:RR:NC:N3:351 CATEGORY: Classification TARIFF NO.: 6307.90.9889 Ms. Kim Roebke Phoenix International Freight Services, Ltd. 1501 North Mittel Boulevard Wood Dale, IL 60191 RE: The tariff classification of an unfinished bag holder from China Dear Ms. Roebke: In your letter dated June 12, 2012, you requested a tariff classification ruling on behalf of your client, Industries for the Blind Incorporated, of West Allis, Wisconsin. You submitted a sample of an unfinished holder/dispenser for plastic bags. The holder is made up of 65% polyester and 35% cotton woven textile fabric. It is 17” long and 8-1/2” wide lying flat. It has elastic strips inserted into both ends with a 4-1/2” hanging loop on one end. One seam is opened and unfinished. When the dispenser is finished, plastic bags can be stuffed inside until needed and then pulled through the bottom for use. The applicable subheading for the unfinished holder for plastic bags will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up textile articles, other. The rate of duty will be 7% ad valorem. Duty rates are provided for your convenience and are subject to change.
