Dear Ms. Arciero: In your letter dated June 7, 2012, on behalf of CVS, you requested a tariff classification ruling. Representative samples were submitted with your ruling and will be returned to you. The product to be imported, referred to as Item number 891397, is a Flameless Candle. This wax LED (light emitting diode) pillar like candle is available in various glittered colors and has a steady flicker which provides a realistic candle effect. Powered by two AA batteries, the candle lamp has a three-position slide switch and a four hour timer built into the bottom. The applicable subheading for the LED candle will be 9405.40.8000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Lamps and lighting fittings…Other electric lamps and lighting fittings: Other. The rate of duty will be 3.9 percent. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
