N219140 June 12, 2012 CLA-2-85:OT:RR:NC:N1:109 CATEGORY: Classification TARIFF NO.: 8507.20.4000 Mr. Christopher Lorenzo Dalipe Accounting Staff Dynacraft BSC Inc. 89 South Kelly Road American Canyon, CA 94503 RE: The tariff classification of a battery charger from Taiwan Dear Mr. Dalipe: In your letter dated May 25, 2012, you requested a tariff classification ruling. The merchandise subject to this ruling is an OD battery charger (item #6-DW-7) for fully electric OPP scooters (item #s 8801-01 and 8801-02). The battery charger is a DC 12V 7Ah sealed lead acid storage battery used as the primary source of electric power. The item weighs 2.68 kg and measures 151mm long, 65mm wide, and 101mm high. The applicable subheading for the battery charger (item #6-DW-7) will be 8507.20.4000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Electric storage batteries, including separators therefore, whether or not rectangular (including square); parts thereof: other lead-acid storage batteries: of a kind used as the primary source of electrical power for electrically powered vehicles of subheading 8703.90.” The rate of duty will be 3.5 percent ad valorem.
