N216804 June 4, 2012 CLA-2-70:OT:RR:NC:N2:226 CATEGORY: Classification TARIFF NO.: 7013.99.5000 Mr. Aaron Cullen Barthco International, division of OHL One CVS Drive Woonsocket, RI 02895 RE: The tariff classification of two decorative glass articles from China Dear Mr. Cullen: In your letter dated April 23, 2012, on behalf of CVS/Pharmacy, you requested a tariff classification ruling. Two representative samples were submitted with your ruling request. These two samples are being returned to you. The product under consideration, designated as item number 889547, is a decorative glass article with silver-colored laser cut designs. You stated that this article will measure approximately 3 ¼ inches in height and 2 ¾ inches in diameter and will be available in two designs. The first design is red with silver trim and has silver designs of reindeer with snow and snowflakes. The other design is blue with silver trim and has silver designs of snow and snowflakes. Although you describe this product as a candle holder, it is not regarded as a lamp or light fitting because dark coloring of this article restricts the dissemination of light. Therefore, this product is regarded as a decorative glass article. You indicated in an email message that the unit value of this product is over thirty cents but not over three dollars. The applicable subheading for the two decorative glass articles, item number 889547, will be 7013.99.5000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for glassware of a kind used for table, kitchen, toilet, office, indoor decoration or similar purposes…other glassware: other: other: other: valued over thirty cents but not over three dollars each. The rate of duty will be 30 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
