McLafferty Grunfeld, Desiderio, Lebowitz, Silverman & Klestadt, LLP 399 Park Avenue, 25th Floor New York, NY 10022-4877 RE: The tariff classification of footwear from China Dear Ms. McLafferty: In your letter dated February 21, 2012 you requested a tariff classification ruling on behalf of your client, Crocs, Inc. for two styles of “garden” clogs. The submitted samples identified as style #’s 12982 and 12915, are women’s and boy’s closed toe/open heel unit molded rubber or plastics garden clogs, respectively. Each upper features numerous vent holes or openings along the vamp/instep and a separate rubber or plastics heel strap attached to each side of the upper by two round plastic rivets. Each clog has a rubber or plastics band that is applied or molded at the sole, a substantial portion of which does not overlap the upper by the required measurements (1/4 of an inch for adults and 3/16th of an inch for children). Consequently, the clogs do not have a foxing band. They also are not “protective” for tariff purposes. The applicable subheading for the women’s garden clog, style #12982 will be 6402.99.3165, Harmonized Tariff Schedule of the United States (HTSUS), which provides for footwear with outer soles and uppers of rubber or plastics: other footwear: other: other: having uppers of which over 90 percent of the external surface area (including any accessories or reinforcements) is rubber or plastics (except footwear having a foxing or a foxing-like band applied or molded at the sole and overlapping the upper and except footwear designed to be worn over, or in lieu of, other footwear as a protection against water, oil, grease or chemicals or cold or inclement weather): other: other: other: for women: other. The rate of duty will be 6 percent ad valorem. The applicable subheading for the boy’s garden clog, style #12915 will be 6402.99.3171, Harmonized Tariff Schedule of the United States (HTSUS), which provides for footwear with outer soles and uppers of rubber or plastics: other footwear: other: other: having uppers of which over 90 percent of the external surface area (including any accessories or reinforcements) is rubber or plastics (except footwear having a foxing or a foxing-like band applied or molded at the sole and overlapping the upper and except footwear designed to be worn over, or in lieu of, other footwear as a protection against water, oil, grease or chemicals or cold or inclement weather): other: other: other: other.
