N203859 February 21, 2012 CLA-2-63:OT:RR:NC:N3:351 CATEGORY: Classification TARIFF NO.: 6307.90.9889 Ms. Martha De Castro Bed Bath & Beyond 650 Liberty Avenue Union, NJ 07083 RE: The tariff classification of a grill cover from China Dear Ms. De Castro: In your letter dated February 3, 2012, you requested a tariff classification ruling. You submitted a sample of the Eco-Cover™ Universal grill cover. The outdoor grill cover is made up of a woven polyester fabric that is lined on the inner surface with polyethylene. This construction is considered a textile fabric for tariff purposes. The grill cover protects outdoor grills from the elements. The grill cover measures 65”L x 25”W x 40”H. To keep the grill cover in place, there are four strips with hook-and-loop closures and four straps that tie on the bottom. The applicable subheading for the Eco-Cover™ Universal Grill Cover, sku #16705543, will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up textile articles, other. The rate of duty will be 7% ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on the World Wide Web at http://www.usitc.gov/tata/hts/. The sample will be returned as you requested. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
