The tariff classification of Motorized Skylight Louvers from the United States
N186012 October 11, 2011 CLA-2-84:OT:RR:NC:1:104 CATEGORY: Classification TARIFF NO.: 8479.89.9899 Ms. Linda S. Drenning Acuity Brands Lighting 1400 Lester Rd Conyers, GA 30012 RE: The tariff classification of Motorized Skylight Louvers from the United States Dear Ms. Drenning: In your letter dated September 22, 2011, you requested a tariff classification ruling. The motorized light control skylight louvers, Frame Model 900, are designed to act as a filter and allow only the required or necessary amount of light into a building. The louvers are mounted over the roof window and open or close dependant upon the intensity of the outside light. This office notes that the roof windows themselves were not included in your ruling request and, thus, are not covered by this ruling. The louver frame and blades are made from aluminum with a baked on enamel finish. The louvers are available with either an exterior or interior motor and in a variety of sizes. Louvers are electrically operated using a standard synchronous 115VAC or 24VAC motor unit. A 60 Hz, 7 Watt motor incorporated in the louver assembly is equipped with limit switches at full open and closed positions. The applicable subheading for the Motorized Skylight Louvers, Frame Model 900, will be 8479.89.9899, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Machines and mechanical appliances having individual functions, not specified or included elsewhere in this chapter, parts thereof: Other machines and mechanical appliances: Other: Other: Other. The general rate of duty will be 2.5% ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
