Dear Mr. MacKenzie: In your letter dated August 23, 2011, you requested a tariff classification ruling. Photos were submitted of a light duty chrome wire shelving unit. The floor standing, light duty shelving unit is made from steel with a chrome nickel finish. The shelving unit measures 63 inches high by 36 inches wide by 16 inches deep. The unit features four steel wire shelves which are held in place to the frame by sixteen pairs of black plastic clips. Each shelf can hold up to 110 pounds. The unit is packaged within a cardboard container and weighs 24 pounds. It is stated that this unit will be used predominately in the home. The applicable subheading for the light duty chrome wire shelving unit, will be 9403.20.0018, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Other furniture and parts thereof: Other metal furniture: Household: Other: Other.” The rate of duty will be Free. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
