N181104 September 9, 2011 CLA-2-73:OT:RR:NC:N1:113 CATEGORY: Classification TARIFF NO.: 7326.90.8588 Mr. George Rose Addiran Global Group, Inc. 5508 Bentrose Drive McKinney, TX 75070 RE: The tariff classification of castings of ductile iron from China Dear Mr. Rose: In your letter dated August 17, 2011, you requested a tariff classification ruling on imported castings of ductile iron. Photographs/drawings, product descriptions and specifications of the castings in question were submitted for our review. The merchandise under consideration is identified in your letter as “Dwg21247 and Dwg82091”. You stated in your letter that the subject Dwg21247 and Dwg82091 are “Castings of 64-45-12 ductile iron manufactured to ASTM A536 to be assembled with a fiberglass support and a pole gain base to make-up an equipment mount or conductor support for use on distribution power lines which will be bolted to a power pole.” The castings of ductile iron are not imported with the fiberglass support or the pole gain base. You indicated in your letter that in its condition as imported “Dwg21247 has a nylon thread over-molded, but no components. The nylon thread portion is made of type 11 nylon. Dwg82091 is only a casting made of 65-45-12 ductile iron, conforming to ASTM A536 and has no additional articles affixed or attached to it at the time of import…Dwg21247 accepts the mounting of a pin type insulator while Dwg82091 allows equipment to be mounted by means of a thru bolt. Both castings of 65-45-12 ductile iron, conforming to ASTM A536, are affixed to a fiberglass rod, which in turn is affixed to a pole gain plate. The entire assembly is then mounted to a power pole with thru bolts. In the case of both Dwg21247 and Dwg82091, they do not ‘connect’ anything, but simply act as a mounting medium.” Dwg21247 and Dwg82091 perform a mounting or attaching function. You stated that you are requesting a classification ruling on the Dwg21247 and Dwg82091 castings of ductile iron only. The applicable subheading for the Dwg21247 and Dwg82091 castings of ductile iron will be 7326.90.8588, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other articles of iron or steel, other, other, other, other, other. The rate of duty will be 2.9 percent ad valorem. Duty rates are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
