Cannata Alto Customhouse Brokers Inc. 145-03 156th Street Jamaica, NY 11434 RE: The tariff classification of footwear from China Dear Mr. Cannata: In your letter dated August 1, 2011 you requested a tariff classification ruling on behalf of importer Donald J. Pliner. The submitted half-pair sample identified as style “#5 Sonia,” is a women’s below-the-ankle slip-on shoe with a molded rubber/plastic outer sole which overlaps the upper by at least ¼ of an inch, thereby constituting a foxing or a foxing-like band. The upper is manufactured with textile material which simulates a “python” snakeskin. You provided an F.O.B. value of $17.00 per pair. The applicable subheading for style “#5 Sonia” will be 6404.19.9060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for footwear with outer soles of rubber/plastics, leather or composition leather and uppers of textile materials: footwear with outer soles of rubber or plastics: not sports or athletic footwear; other: valued over $12.00/pair: for women. The rate of duty will be 9% ad valorem. Duty rates are provided for your convenience and are subject to change.
