Dear Ms. Harris: In your letter dated July 8, 2011, you requested a tariff classification ruling. The sample will be returned to you. The submitted sample, item 5600342001, is a headband comprised of a metal chain and plastic pearl beads, twisted together over a woven textile headband. The headband has an elastic cord at the back to secure the headband to the head. The essential character of the headband is the textile portion. The applicable subheading for Item 5600342001 will be 6217.10.8500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Other made up clothing accessories; parts of garments or clothing accessories, other than those of heading 6212 Accessories: Other: Headbands, ponytail holders and similar articles." The rate of duty will be 14.6 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
