Dear Ms. Berry: In your letter dated May 25, 2011, on behalf of Hancock Fabrics, Baldwyn, MS, you requested a tariff classification ruling. The instant sample, identified as style “Pleather MA03-1, consists of a material containing three distinct layers. Specifically, there is a backing fabric of warp knit construction that is composed of 100 percent polyester man-made fibers that has been bonded to an upper layer of 100 percent polyester fabric having a woven construction. This upper layer has been uniformly and visibly coated with a polyurethane plastics material (cellular). Finally, this polyurethane plastics layer has been partially flocked with nylon man-made fibers to produce an animal fur skin appearance. Your letter indicates that this material is not over 70 percent by weight of the polyurethane plastics portion. The applicable subheading for the material will be 3921.13.1500, Harmonized Tariff Schedules of the United States (HTSUS), which provides for other plates, sheets, film, foil and strip, of plastics, cellular, of polyurethanes, combined with textile materials, products with textile components in which man-made fibers predominate by weight over any other single textile fiber, not over 70 percent by weight of plastics. The rate of duty will be 6.5 percent ad valorem.       Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
