N158956 May 4, 2011 CLA-2-88:OT:RR:NC:N1:106 CATEGORY: Classification TARIFF NO.: 8803.30.0030 Gail Mason Airbus Americas, Inc. 21780 Filigree Court Ashburn, VA 20147 RE: The tariff classification of an aircraft bearing from Germany Dear Ms. Mason: In your letter dated April 6, 2011, you requested a tariff classification ruling. The items under consideration have been identified as four (4) parts you state are used in the nose landing gear of a civil aircraft. The first part, a spherical bearing (Part # F00030017), is inserted into the flanged bushing, which you identify as the second part under consideration (Part # F53112289). The applicable subheading for the both the spherical bearing (Part # F00030017) and flanged bushing (Part # F53112289) will be 8803.30.0030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Parts of goods of heading 8801 or 8802: Other parts of airplanes…: For use in civil aircraft: Other”. The duty rate will be Free. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. Your inquiry does not provide enough information for us to give a classification ruling on the adjustable shim (Part # F32210128). Your request for a classification ruling should include the following information: What is the purpose of the shim? How does the shim adjust? Does the shim act as a mount for any other part? In addition to the above, your inquiry does not provide enough information for us to give a classification ruling on the journal bearing assembly. You indicate that the bearing assembly is used in a door handle mechanism assembly on a civil aircraft. Please identify the components that make up the bearing assembly. What type of bearing (spherical, rod end, etc.) is used in the assembly? What is the overall function of the bearing with regard to the operation of the door handle mechanism? In addition, please submit attachment D52371303 which was not included in your original submission. When this information is available, you may wish to consider resubmission of your request. We are returning any related samples, exhibits, etc. If you decide to resubmit your request, please include all of the material that we have returned to you. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
