Dear Ms. Helm: In your letter dated March 14, 2011 you requested a classification ruling on behalf of GFSI. As requested, your sample is being returned to you. The submitted sample, style UW1572, is an “Under Armour Green” brand woman’s sleeveless vest constructed from 100% polyester knitted fabric that has been brushed on the underside. The garment features oversized armholes, a drawstring hood, a full front zippered opening, the “Under Armour” logo embroidered on the lower left front panel, two kangaroo pockets at the waist, and a self-fabric banded garment bottom. The applicable subheading for the vest will be 6110.30.3035, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: Of man-made fibers: Other: Other: Other: Other: Vests, other than sweater vests: Women’s or girls’. The duty rate will be 32% ad valorem. Duty rates are provided for your convenience and are subject to change.
