Box 1199 Williston, VT 05495 RE: The tariff classification of a ceramic trinket box from China. Dear Ms. Pendris: In your letter dated February 24, 2011, you requested a tariff classification ruling. The merchandise under consideration is a Ceramic Trinket Box, item number 68220. A sample of the trinket box was submitted with your ruling request, and was forwarded to our U.S. Customs and Border Protection Laboratory for analysis. This analysis has been completed. The Ceramic Trinket Box is an ornamental keepsake box with a hinged lid, measuring approximately 1.5 inches high by 2.75 inches in diameter. The box is decorated with black and orange glaze with blue flower and star designs. You state in your ruling request that it is made of porcelain with gold-plated zinc alloy hinge rings. However, analysis by our laboratory has determined that the Ceramic Trinket Box is made of white earthenware ceramic, and the hinge rings are made of zinc plated with brass with traces of cobalt and gold. Although the Ceramic Trinket Box has the capability of being used as a storage container, it is primarily an ornamental article, with the ancillary feature of being a trinket box. The applicable subheading for the Ceramic Trinket Box, item number 68220, will be 6913.90.5000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Statuettes and other ornamental ceramic articles: Other: Other: Other.” The general rate of duty will be 6 percent ad valorem. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
