N149876 March 1, 2011 CLA-2-29:OT:RR:NC:N2:238 CATEGORY: Classification TARIFF NO.: 2934.99.3000 Ms. Aoife Moloney Camida Tower House, New House Tipperary Ireland RE: The tariff classification of Aprepitant (CAS-170729-80-3) in bulk form, from India Dear Ms. Moloney: In your letter dated February 22, 2011, you requested a tariff classification ruling. The subject product, Aprepitant, is a selective high-affinity antagonist of human substance P/neurokinin 1 (NK1) receptors. It is indicated for the prevention of acute and delayed nausea and vomiting caused by cancer chemotherapy treatment. It is also indicated for the prevention of postoperative nausea and vomiting. You stated in your letter that it will be imported in 100 grams. The applicable subheading for the Aprepitant will be 2934.99.3000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Nucleic acids and their salts, whether or not chemically defined; other heterocyclic compounds: Other: Other: Aromatic or modified aromatic: Other: Drugs.” Pursuant to GN 13, HTSUS, the rate of duty will be free. Duty rates are provided for your convenience and are subject to change.
