N139377 January 10, 2011 CLA-2-19:OT:RR:NC:2:228 CATEGORY: Classification TARIFF NO.: 1901.90.9095 Ms. Maria Osborn Patagonia Kitchen LLC 6315 B FM 1488 #231 Magnolia, TX 77354 RE: The tariff classification of frozen chicken empanadas from Argentina Dear Ms. Osborn: In your letter dated December 20, 2010, you requested a tariff classification ruling. An ingredients breakdown was submitted with your letter. Deep Frozen Chicken Empanadas, described as “stuffed pastries,” are turnovers composed of an uncooked disc of pastry dough, folded in the middle over a filling consisting of chicken, onion, egg, red pepper, vegetable oil, margarine, flour, salt and spices, sealed at the edges, and frozen. The empanada contains less than 20 percent chicken. The applicable subheading for the frozen chicken empanadas will be 1901.90.9095, Harmonized Tariff Schedule of the United States (HTSUS), which provides for food preparations of flour, groats, meal, starch or malt extract, not containing cocoa…other…other…other…other. The rate of duty will be 6.4 percent ad valorem. Duty rates are provided for your convenience and are subject to change. Articles classifiable under subheading 1901.90.9095, HTSUS, which are products of Argentina may be entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations. The GSP is subject to modification and periodic suspension, which may affect the status of your transaction at the time of entry for consumption or withdrawal from warehouse.
