Sam Houston Pkwy E Suite 120 Houston, TX 77032 RE: The tariff classification of a radio network system from New Zealand Dear Ms. Pena: In your letter dated November 23, 2010 you requested a tariff classification ruling. The merchandise subject to this ruling is a radio network system. The basic radio network system is comprised of a rack with one or more base station/repeaters, one or more reciter modules (receiver/exciter apparatus), a power management unit, one or more power amplifiers, and mobile or portable radio telephones specifically coded to the system with a particular frequency for a closed 2-way communication among employees. Each system is designed and built according to the needs of the individual customer with one or more channel capability, one or more site capability, and for the number of employees who will need to use the system. Additional equipment and software can be added to the system to meet the customer’s requirements. The radio network system is shipped disassembled for safe transport to its end site. Although this device is called a radio, it is not a radio broadcasting device, but rather a two-way communication device for use on a closed proprietary network. The applicable subheading for the radio network system will be 8517.62.0050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Machines for the reception, conversion and transmission or regeneration of voice, images or other data, including switching and routing apparatus: Other." The rate of duty will be free. Duty rates are provided for your convenience and are subject to change.
