A-3A Building A5 Valley Stream, NY 11581 RE: The tariff classification of an adhesive tape, for use in cable harnesses in the automotive industry, from either Germany, Singapore or China. Dear Mr. Gerard: In your letter dated October 15, 2010, on behalf of Great Lakes Tape Corporation, Sterling Heights, MI, you requested a tariff classification ruling. Your sample is being retained for our files. The instant sample is identified as Polyester Fabric Tape – GLT 525 3000 Series. It consists of a roll of adhesive tape that you state is of a woven polyester man-made fiber construction that `1has been coated on one surface with an acrylate based adhesive coating. This coating is visible to the naked eye. The tape you submitted to this office measures ¾" in width. You write, however, that this tape may be imported in widths of 19 or 25 mm and lengths of 25, 50 or 75 meters. While you did not provide a specific breakdown by weight, the plastics portion does not appear to be over 70 percent by weight of the total weight of the material. The applicable subheading for the product will be 5903.90.2500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for textile fabrics impregnated, coated, covered or laminated, with plastics, of man-made fibers, not over 70 percent by weight of plastics. The duty rate is 7.5 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
