Arango, Inc. 1516 E. 8th Avenue Tampa, FL 33605 RE: The tariff classification of shopping-style tote bags from China Dear Mr. Alberdi: In your letter, which was not dated, you requested a tariff classification ruling on behalf of your client, Hit Promotional Products. Your samples will be returned to you. Style 3335 is a non-woven polypropylene (PP) shopping-style tote bag that is coated on the outer surface with a plastic sheeting material. The interior of the bag is unlined and consists of a single compartment with no additional features. It has an open top with two carrying handles. It is designed to provide protection, portability, storage, and organization to clothing, sundry articles, or personal effects during travel. The bag is of a durable construction and capable of repetitive use. It measures approximately 15” (W) x 12.5” (H) x 6.25” (D), Style 3336 is a non-woven polypropylene shopping-style tote bag that is coated on the outer surface with a plastic sheeting material. The interior of the bag is unlined and consists of a single compartment with no additional features. It has an open top with two carrying handles. It is designed to provide protection, portability, storage, and organization to clothing, sundry articles, or personal effects during travel. The bag is of a durable construction and capable of repetitive use. It measures approximately 12.5” (W) x 15.5” (H) x 5” (D). Style 3337 is a non-woven polypropylene shopping-style tote bag that is coated on the outer surface with a plastic sheeting material. The interior of the bag is unlined and consists of a single compartment with no additional features. It has an open top with two carrying handles and a reinforced bottom. The front exterior of the bag has an open pocket. It is designed to provide protection, portability, storage, and organization to clothing, sundry articles, or personal effects during travel. The bag is of a durable construction and capable of repetitive use. It measures approximately 13” (W) x 14.5” (H) x 10” (D). The applicable subheading for shopping-style tote bags will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for travel, sports and similar bags, with outer surface of sheeting of plastic, other. The general rate of duty is` 20 percent ad valorem. Styles 3335, 3336, and 3337 do not meet the prerequisites for special treatment under subheading 9902.40.01, HTSUS. While they are constructed from non-woven polypropylene textile material, the outer most surface of each bag is a plastic sheeting material. The general rate of duty will apply. Duty rates are provided for your convenience and are subject to change.
